Terms of Service

By using Anva you agree to these terms. In short: use the service lawfully and only with faces and voices you have the right to use; avatars are AI-generated; you're responsible for how you deploy them; and the service is provided “as is”.

1. Acceptance & eligibility

Anva is a product of Penguin Robotics (penguinrobotics.net), the operator of the service and the party to these Terms. By creating an account or using Anva you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. You must be at least 13 (or the minimum age in your country) and able to form a binding contract. If you use Anva for an organization, you represent that you're authorized to bind it.

2. The service

Anva lets you generate AI avatars from photos and run real-time conversational sessions, embed them, and access them via our API. We may change, suspend, or discontinue features over time.

3. Your account

You're responsible for your account, your API keys, and all activity under them. Keep your credentials secure and notify us of any unauthorized use.

4. Your content & the rights you grant

You retain ownership of the photos, prompts, and other content you provide (“Your Content”). You grant us a worldwide, non-exclusive license to host, process, and display Your Content solely to operate and provide the service to you.

You represent and warrant that you own or have all rights, consents, and permissions necessary to use any face, likeness, name, or voice in Your Content, and that your use of Anva won't infringe anyone's rights or violate any law. This is a core condition of using Anva — see the Acceptable Use Policy.

5. AI-generated content

Avatars, voices, and conversation responses are generated by AI. They are synthetic, may be inaccurate or inappropriate, and should not be relied upon as fact, advice, or the statements of any real person. You're responsible for reviewing outputs and for how you deploy avatars, including clearly disclosing to your users that they're interacting with an AI where required.

6. Acceptable use

Your use must comply with our Acceptable Use Policy. We may remove content, disable avatars, and suspend or terminate accounts that violate it.

7. Payment

Paid plans are billed through Stripe on the terms shown at purchase. Usage above your plan's included amount may incur overage charges where applicable. Fees are non-refundable except where required by law. We may change pricing with notice; changes apply to future billing periods.

8. Intellectual property

Anva and its software, branding, and content (excluding Your Content) are owned by us and protected by law. We grant you a limited, revocable, non-transferable right to use the service under these Terms.

9. Termination

You may stop using Anva and delete your account at any time. We may suspend or terminate access for violations of these Terms or the Acceptable Use Policy, for legal reasons, or to protect the service. On termination, your right to use the service ends; certain provisions survive (e.g. ownership, disclaimers, limitations, indemnity).

10. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that AI outputs will be accurate or suitable.

11. Limitation of liability

To the maximum extent permitted by law, Anva will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

12. Indemnification

You agree to indemnify and hold Anva harmless from claims arising out of Your Content, your use of the service, or your violation of these Terms or the Acceptable Use Policy — including claims that an avatar you created infringed someone's rights or was used to deceive or harm.

13. Governing law & disputes

The Anva service is operated by Penguin Robotics. These Terms are governed by the laws of the jurisdiction in which Penguin Robotics is incorporated, without regard to conflict-of-laws rules. The courts located in that jurisdiction have exclusive venue over any dispute arising from these Terms or the service, and you consent to their jurisdiction.

14. Changes

We may update these Terms; we'll update the “Last updated” date and, for material changes, provide additional notice. Continued use after changes means you accept them.
